{"id":9432,"date":"2018-12-20T12:24:13","date_gmt":"2018-12-20T17:24:13","guid":{"rendered":"http:\/\/www.bobfelton.com\/?p=9432"},"modified":"2018-12-20T12:24:13","modified_gmt":"2018-12-20T17:24:13","slug":"neutered-doj-ethics","status":"publish","type":"post","link":"http:\/\/www.bobfelton.com\/?p=9432","title":{"rendered":"Neutered: DOJ Ethics"},"content":{"rendered":"<p>Though Acting Attorney General Matthew Whitaker plainly <a href=\"https:\/\/talkingpointsmemo.com\/muckraker\/acting-ag-whitaker-wrote-op-ed-suggesting-mueller-probe-went-too-far\" target=\"_blank\">positioned himself<\/a> to secure the top job by actively and loudly criticizing the Mueller investigation, the Department of Justice ethicist has cleared him to superintend the increasingly fruitful investigation.<\/p>\n<div style='width: 160px; text-align: right; border: 0px; padding: 5px; background: #ffffff; font-size: 16px; font-style: normal; text-transform: none; font-family: Helvetica, Arial, sans-serif; color: #000000; line-height: 18px;' class=\"alignright\" style=\"float: right;margin:10px;\" >\n<hr>\n<p><b>&#8220;We\u2019ve already heard rumors on the wind about Sessions\u2019 tenure, so suddenly we could have a President that understands that if I control the Department of Justice, I control this investigation.&#8221;<\/b><\/p>\n<p><a href=\"https:\/\/talkingpointsmemo.com\/muckraker\/acting-ag-whitaker-wrote-op-ed-suggesting-mueller-probe-went-too-far\" target=\"_blank\">Matthew Whitaker<\/a><\/p>\n<hr>\n<\/div>\n<p>Since Whitaker was well known to be hostile to the investigation at the time of the remark on the right, it can&#8217;t reasonably be construed as anything but an implicit promise to scuttle the investigation if he controls the department; there is no way that he can be cleared ethically; the <i>quid pro quo<\/i> is in plain sight.  The ethicists are wrong &#8212; and probably cowed.<\/p>\n<p>After all, recall the experience of White House ethics lawyer <a href=\"https:\/\/www.politico.com\/story\/2018\/07\/25\/white-house-lawyer-passantino-planning-to-leave-740493\" target=\"_blank\">Stefan Passantino<\/a>.<\/p>\n<blockquote>\n<p>\u201cI am amazed he made it as long as he did.
